Robert H. Berman

Mr. Berman is Of Counsel to the K&B firm, and a senior attorney whose legal practice includes commercial and real estate transactions and disputes, including administrative law proceedings and all aspects of litigation, from the taking of discovery through conducting trials, and arguing appeals.

Prior to joining the K&B firm, Mr. Berman was a Senior Partner at the BORAH, GOLDSTEIN, ALTSCHULER, NAHINS & GOIDEL, P.C. law firm, and the supervising partner of the firm’s Administrative Division, specializing in all types of proceedings before administrative agencies including the following: New York State Division of Housing and Community Renewal (DHCR), New York City Environmental Control Board (ECB), New York City Department of Housing Preservation and Development (HPD) and New York City Department of Buildings (DOB). He has over 34 years of real estate law experience, since 1974, with almost nine years as an Assistant Counsel in the New York City Office of Rent Control. Mr. Berman’s practice areas include all of the following:
     - Prosecution of luxury decontrol proceedings (he has handled over 400 cases
            each year, and has participated in seminal litigation concerning various
            luxury decontrol issues)
     - applications for a major capital improvement (MCI) rent increase
     - applications for a maximum base rent (MBR) increase
     - applications for J-51 property tax exemptions and abatements pursuant to
            the J-51 tax benefit program of the City of New York administered by
            the HPD
     - demolition and/or substantial rehabilitation applications before the DHCR
     - rent registrations
     - defense of rent overcharges complaints
     - defense of fair market appeals
     - defense of rent registration disputes
     - obtaining certificates of no harassment from the HPD
     - defense of tenant initiated complaints regarding an alleged reduction of
           services or alleged harassment
     - defense of challenges to rent increases

Mr. Berman has provided legal counsel to many of the real estate industry’s major owners and managing agents.

Mr. Berman earned a Bachelor of Business Administration degree from Baruch College (1970), and a Juris Doctor degree from Brooklyn Law School (1974). He is admitted to practice before all of the trial and appellate courts in the state of New York. In addition, he is a member of the bar of the following federal courts: U.S. District Court for the Southern District of New York and U.S. District Court for the Eastern District of New York.

Mr. Berman is a member of the New York State Bar Association and the New York County Lawyers’ Association (NYCLA). He is a member of the NYCLA Administrative Law Committee and the NYCLA Civil Court Practice Section, and has lectured on DHCR issues before many groups.
